A. Caution Against Use of Fictitious, Misleading, False or Fraudulent Information

The contract between Users and the Trust will be void ab initio (retroactively) in the event any fictitious, misleading, false or fraudulent information is used by you in the process of registration or application for enrollment or at any other time. For your own personal security, the name which you provide in the Sites’ contact and/or registration forms does not necessarily have to be your real name, but you explicitly accept all responsibility and full liability for any damages, claims or other consequences that may arise as a result of entering into a contract with the Trust under fictitious, misleading, false or fraudulent User information.

B. Compliance with Legitimate Requests by Authorities

While we respect and try to protect your privacy to the best of our abilities, your use of the Sites does not place you above the law. But neither do we place authorities above the law. If we receive a request by competent judicial authorities to hand over information about one of our Users, we will check the validity of the request and determine whether we are obliged to comply. We will NOT comply with such requests unless we are convinced that the request is valid and we believe it is undeniably our legal obligation to comply.

We will not comply with requests from any authorities other than competent authorities, meaning authorities with legal jurisdiction to make the request. If we receive a request from any foreign government, we will refuse to comply and will instead refer the requestor to place a formal request to the competent authorities for mutual assistance.

The Trust will never cooperate with any voluntary surveillance programs. Under the strong current laws that protect the right to privacy in Europe, Asia, South Pacific, and North America, governments cannot legally force private communities to implement a blanket spying program on their Users. Should that ever change, we will use all methods at our disposal to resist or we will terminate the Service.

C. Requests by Private Third Parties

We will not comply with any requests from private third parties to provide information about our Users, unless we would receive a valid court order, from a court of competent jurisdiction, to such effect.

D. De Facto Compliance

Irrespective of any purported de facto compliance with the Children’s Online Privacy Protection Act, 15 U.S.C., §§ 6501-06 and 16 C.F.R., §§ 312.1-312.12, our Sites do not permit persons under 18 years of age to become Users, and we do not collect information from children. By using our Sites, you represent that you are not under 18 years of age.

E. Feedback & Comments

Except with regard to any contact information you may provide us via the Sites, all comments, feedback, information or materials submitted to the Trust through or in association with this website (collectively, "Feedback") will be considered non-confidential and the property of the Trust. By submitting such Feedback to the Trust, you agree that you assign to the Trust, without charge, all worldwide rights, title and interest, including copyrights and other intellectual property rights, in and to the Feedback. The Trust shall be free to use such Feedback on an unrestricted basis.

When posting comments, be aware that other Users may be able to identify you, or associate you with your account if you include personal information in the content you post. The Sites have security measures in place to protect against the loss, misuse and alteration of the information under our control; however, the Trust does not guarantee the performance or adequacy of such security measures.
